3.3. You are solely responsible for all activities that occur under your account.

4.1. Subscriptions are billed on a recurring basis until canceled.

4.2. ALL PAYMENTS ARE NON-REFUNDABLE.

4.3. You may cancel your subscription at any time through your account dashboard.

4.4. Cancellation will take effect at the end of your current billing period.

4.5. We reserve the right to change our pricing with 30 days notice.

5.1. You retain ownership of all Content generated through our Services.

5.2. You are solely responsible for all Content generated using your account.

5.3. You warrant that your use of the Services and any generated Content will not:

• Violate any applicable laws or regulations
• Infringe upon any third-party rights
• Contain harmful, offensive, or inappropriate material
• Be used for any illegal or unauthorized purpose

5.4. You grant us a limited licence solely to store, schedule, and transmit your content to TikTok via its Content Posting API.

6.1. Use automated scripts or bots to access the Services

6.2. Attempt to reverse engineer the Services

6.3. Share or resell your account access

6.4. Generate Content that violates our content policies

6.5. Use the Services to create spam or malicious content

6.6. Attempt to circumvent any usage limitations or security measures

6.7. Fail to comply with TikTok Community Guidelines or attempt to remove watermarks / bypass TikTok rate limits

7.1. The Services, including all software, algorithms, and interfaces, are protected by copyright and other intellectual property laws.

7.2. You may not copy, modify, distribute, sell, or lease any part of our Services.

7.3. HyperUGC retains all rights to the underlying AI technology and systems.

8.1. IN NO EVENT SHALL HYPERUGC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

8.2. OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE PAST THREE MONTHS.

You agree to indemnify and hold harmless HyperUGC, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from:

10.1. We do not guarantee uninterrupted access to the Services.

10.2. We may modify, suspend, or discontinue any aspect of the Services at any time.

10.3. We are not liable for any service interruptions or data loss.

11.1. Your use of the Services is subject to our Privacy Policy.

11.2. We implement reasonable security measures but cannot guarantee absolute security.

12.1. We may terminate or suspend your access immediately for any violation of these Terms.

12.2. Upon termination:

13.1. These Terms are governed by the laws of the State of Delaware, United States.

13.2. Any disputes shall be resolved exclusively in the courts of Delaware.

13.3. You agree to submit to the personal jurisdiction of such courts.

14.1. We reserve the right to modify these Terms at any time.

14.2. Changes will be effective upon posting to our website.

14.3. Your continued use of the Services constitutes acceptance of any changes.

HyperUGC integrates with various third-party APIs. The following compliance item applies to all users and our operation of the platform:

• YouTube API Services Terms of Service link in the site footer – mandatory for all applications that access or use YouTube APIs (Google Developer Policy Section III.D.9). See the footer below for the active link.
• TikTok Integration Notice – OAuth login, video upload, and analytics retrieval use TikTok APIs; your use of TikTok is governed by TikTok's Terms and Privacy Policy.

TikTok does not accept a publish_time parameter. Scheduling occurs on our servers; actual publish time may vary due to API limits, network latency, or TikTok outages.

Analytics are returned "as-is" from TikTok's Display API and may differ from numbers shown in the TikTok app.
